The Shimla District Court has upheld the municipal commissioner’s order to demolish the illegal Sanjauli mosque, marking a major development in a long-standing dispute over encroachment and construction violations. The ruling reaffirms the May 3, 2024 order of the Shimla Municipal Commissioner that declared the structure illegal under the Himachal Pradesh Municipal Act.
According to legal representatives, the court’s verdict removes all existing stays, allowing municipal authorities to proceed with demolition as per law.
The Himachal Devbhoomi Sangharsh Samiti (HPDSS) hailed the verdict as a “historic moment” and a victory for the people of Shimla.
HPDSS convener Bharat Bhushan expressed satisfaction, saying the judgment upheld the rule of law and reflected the will of the residents who opposed illegal encroachments.
He criticized the mosque committee’s plan to challenge the verdict, calling it “duplicitous and misleading.” Bhushan stated that the committee had 14 years to defend its case but failed to present valid ownership or construction documents.
The HPDSS also levelled sharp accusations against the Shimla police and the state government, alleging bias in handling the case. Bhushan claimed that authorities targeted local protesters through baton charges and police cases, while ignoring illegal settlers and infiltrators.
“The police have failed to act against Bangladeshi and Rohingya infiltrators but are quick to act against locals who stand for legality,” Bhushan alleged. He termed the administration’s stance as “pro-cleric” and vowed to continue the Samiti’s movement until all illegal structures are removed.
Advocate Jagatpal, representing the Hindu side, confirmed that the District Court validated the earlier municipal order declaring the mosque illegal. He clarified that under Section 253(3), the mosque committee has no right to appeal the order before the same authority and may only file a writ petition, which lacks a fixed time frame.
He added, “With this verdict, there is no longer any stay on the mosque. The Municipal Corporation should immediately act on demolition.”
Following the court order, the HPDSS has announced plans to submit a memorandum to the Shimla Municipal Commissioner, demanding swift execution of the demolition process. The group stated it would not rest until the court’s directive is fully implemented and all illegal encroachments are cleared from the Sanjauli area.
The case has triggered a wider debate on illegal religious structures, municipal governance, and law enforcement impartiality in Himachal Pradesh.
