A special POCSO court in Mumbai has granted temporary bail to an 18-year-old accused in a rape case, allowing him to appear for the NEET-UG 2026 re-test scheduled for June 21. The decision has drawn attention due to the balance the court sought to maintain between the accused's right to education and the ongoing criminal proceedings against him.
The court granted bail for a period of four days, from June 18 to June 21, and directed the accused to surrender before authorities by 2 pm on June 22. The accused is currently lodged in Taloja Central Prison in Navi Mumbai and had approached the court seeking permission to take the national-level medical entrance examination.
While granting temporary relief, the court imposed several conditions aimed at protecting the interests of the survivor and ensuring that the accused complies with the law.
One of the significant factors considered by the court was the survivor's response to the bail request. According to court proceedings, the survivor did not object to the temporary bail, provided that the accused refrains from threatening, harassing, or defaming her and her family during the bail period.
The court accepted these assurances and allowed the accused to leave custody solely for the purpose of appearing in the examination.
As part of the conditions, the accused was directed to furnish a personal bond of Rs 50,000 along with a surety of the same amount. The court emphasized that the temporary release was limited in nature and would remain valid only for the specified duration.
Authorities have also been instructed to ensure compliance with the conditions laid down in the order. Failure to adhere to these terms could result in legal consequences and affect future bail considerations.
The National Eligibility cum Entrance Test (NEET-UG) re-examination is scheduled to take place on June 21 following controversies surrounding the original examination. Thousands of candidates across the country are expected to appear for the re-test, which will determine admissions to medical colleges across India.
The accused argued that missing the examination could significantly impact his educational future, prompting the request for temporary bail. The court considered the academic implications while ensuring that safeguards for the survivor remained in place.
The case highlights the complex legal questions courts often face when dealing with accused individuals pursuing educational opportunities while criminal proceedings are underway. Indian courts have, in certain circumstances, allowed temporary relief for examinations, employment obligations, or medical emergencies, subject to strict judicial oversight.
Legal experts note that the latest order does not affect the merits of the criminal case and should not be interpreted as a judgment on the allegations. The trial and investigation process will continue independently as per law.
The accused is required to return to custody after completing the examination and surrender before the authorities within the timeframe specified by the court.
