The Bombay High Court has revoked the bail previously granted to a man accused of gangrape, after observing that the Dindoshi Sessions Court overlooked critical evidence and failed to account for the gravity of the crime. The accused has been directed to surrender immediately.
Justice Neela Gokhale remarked that considering the accused’s impending marriage as a reason for bail was “troubling” and legally untenable. The trial court had released the man on February 24, 2025, after he spent roughly two and a half months in custody, citing his forthcoming wedding. However, the marriage had not been solemnised.
The 2024 case, registered at DN Nagar police station in Mumbai, involves three men who allegedly spiked a woman’s drink, physically assaulted her causing head injuries, tied her up, and gangraped her. Medical reports confirmed the survivor’s injuries, while her statement and witness testimonies, including her uncle’s, corroborated the assault.
Justice Gokhale emphasized that the trial court erred by weighing the absence of injuries to private parts and the accused’s impending marriage more heavily than the severity of the charges. She concluded that both Indian law and Supreme Court precedents make it clear that such factors cannot override the seriousness of the crime.
The High Court’s decision underscores the judiciary’s commitment to prioritizing victim rights and upholding the rule of law in cases of sexual assault.
