West Bengal BJP chief Samik Bhattacharya says bail for former RG Kar principal Sandip Ghosh is not an acquittal, citing pending allegations and legal considerations.

West Bengal BJP chief Samik Bhattacharya says Sandip Ghosh's bail should not be interpreted as proof of innocence.

The Sandip Ghosh bail decision has prompted a political reaction in West Bengal, with state BJP president Samik Bhattacharya saying that the grant of bail does not establish the former RG Kar Medical College and Hospital principal's innocence.

Bhattacharya said the legal process must be distinguished from public emotions and stressed that bail is a legal right. The Supreme Court granted Ghosh bail in a case involving alleged financial irregularities at the hospital and manipulation of merit scores to favour ineligible candidates.

The case has attracted attention amid the wider public outcry following the rape and murder of a doctor at RG Kar Medical College and Hospital on August 9, 2024.

BJP Chief Says Bail Is Not Acquittal

Speaking about the response among those associated with the Abhaya movement, Bhattacharya said people might feel disheartened by the development. However, he maintained that a bail order should not be treated as a final judgment on the allegations.

He argued that legal and technical considerations could have influenced the decision and reiterated that the grant of bail did not amount to a finding of innocence.

His remarks reflect the political debate surrounding Ghosh's release while proceedings connected to the allegations continue. Claims about involvement in alleged offences remain subject to the legal process and must not be treated as established solely on the basis of political statements.

Why the Supreme Court Granted Bail

The Supreme Court reportedly considered the nearly two years Ghosh had spent in custody and the slow progress of the trial while granting relief. Ghosh had approached the apex court after his bail pleas were rejected by a special CBI court and the Calcutta High Court.

The case involving alleged financial irregularities remained separate from the rape and murder proceedings.

In December 2024, a Sealdah court granted Ghosh bail in the rape and murder case after the CBI failed to file a chargesheet within the mandatory 90-day period. He nevertheless remained in custody in the financial irregularities case.

The West Bengal government sanctioned his prosecution in the corruption case on May 18, 2026, according to the information provided.

Legal Proceedings Remain Central

Bhattacharya maintained that Ghosh's release on bail should not be interpreted as exoneration. The distinction is important: bail permits release under the applicable legal conditions, while questions of guilt or innocence are determined through judicial proceedings.

The cases involving Ghosh continue to draw public and political attention, particularly because of their connection to the wider controversy surrounding RG Kar Medical College and Hospital.
