Delhi High Court Stays Order Halting Uday Bhanu Chib’s Bail

The Delhi High Court on Monday stayed a sessions court order that had temporarily halted the bail granted to Indian Youth Congress president Uday Bhanu Chib in connection with the AI Impact Summit protest case.

A bench led by Justice Saurabh Banerjee observed that the sessions court had failed to clearly record its reasoning while granting an interim stay on the bail order earlier issued by a magistrate court. The High Court questioned whether there had been sufficient application of mind in passing the lower court’s directive.

“Some application of mind has to be there. If there is no application of mind, the order has to be stayed,” the court remarked during the hearing. The judge further pointed out that the sessions court’s order described the case as “rare and exceptional” but did not elaborate on the factual findings supporting that conclusion.

The High Court noted the absence of detailed reasoning in the sessions court’s decision. “Where is reasoning in this order? You see page one. Turn over the page. Where is reasoning or finding?” Justice Banerjee asked in open court, underscoring the importance of judicial clarity when suspending a bail order.

Following the High Court’s intervention, Chib’s counsel indicated that they were awaiting the official copy of the order and that the Youth Congress leader could be released later in the day, subject to procedural formalities.

Background of the Case

The matter stems from a protest staged by Indian Youth Congress workers during the India AI Impact Summit held on February 20 in Delhi. According to police, a group of protesters entered the venue wearing and holding white T-shirts bearing images of Prime Minister Narendra Modi and US President Donald Trump, along with slogans related to the India-US trade deal and other political references.

Authorities alleged that the protesters engaged in a scuffle with security personnel and police officers deployed at the venue. Chib was subsequently arrested in connection with the incident.

On February 28, a sessions court granted an interim stay on the bail earlier provided by a magistrate court. The sessions court had stated that when granting an ex parte ad interim stay of a bail order, reasons must be recorded and such powers should be exercised only in very rare and exceptional circumstances.

The High Court’s decision to pause that order has once again brought focus to the procedural safeguards involved in bail matters and the requirement for detailed judicial reasoning when liberty is curtailed.

The case is expected to see further legal proceedings in the coming days.
