FSSAI Tells Supreme Court Red Warning Labels for High-Sugar, Salt and Fat Foods

The Food Safety and Standards Authority of India (FSSAI) has told the Supreme Court that packaged foods high in sugar, salt or fat will carry red warning labels on the front of the pack. The proposed label will be a red hexagon on a white square, positioned at the top left and indicating whether a product is high in sugar, salt or fat.

FSSAI submitted a 43-page affidavit after the Supreme Court raised 13 questions about the proposed system. It said the label would consider added sugar and added fat, while saturated and trans fats would not receive separate front-of-pack warnings under the proposed framework. Existing rules already regulate industrial trans fat, FSSAI said.

The authority has proposed around four months to finalise the rules, including a 60-day period for public and WTO comments. Companies would then receive a 365-day transition period. Since labelling changes take effect on July 1 under FSSAI policy, the new warnings may become mandatory as early as July 2028.

FSSAI also said processing levels would not determine whether a warning is required; the decision would be based on nutrient content. The proposed label may use English or Hindi text, without separate pictograms for individual nutrients.

The authority has also proposed nutrition-literacy initiatives in schools and said existing rules cover artificial sweeteners and additives. However, questions remain over the exact thresholds, implementation timeline and the rationale behind several elements of the proposed system.
