Delhi High Court Gives Reliance Relief in Campa ‘Energy Drink’ Label Row

The Delhi High Court has allowed Reliance to continue marketing Campa products as “energy drinks” until the next hearing, providing temporary relief in its dispute with FSSAI.

The Campa energy drink label dispute has taken a new turn after the Delhi High Court granted Reliance Industries temporary relief in its challenge against the Food Safety and Standards Authority of India (FSSAI). The court has allowed Reliance to continue marketing its Campa products as “energy drinks” until the matter is heard again.

The dispute stems from an FSSAI order issued on June 30 directing manufacturers of high-caffeine beverages sold as “energy drinks” to stop using the description.

Why Reliance Challenged the FSSAI Order

Reliance Consumer Products, the beverages arm of Reliance, challenged the regulator’s order, arguing that it had disrupted its business operations.

During Tuesday’s hearing, the Delhi High Court questioned FSSAI on why the regulator had not issued a notice to Reliance before passing the order. The court indicated that the procedural issue could still be corrected.

The case will next be heard on November 5.

Reliance Had Large Inventory With the Label

The company told the court that it had 168 million cans and 120 million plastic bottles of finished products carrying the “Energy Drink” label.

It also had pre-printed packaging for another 400 million cans and 360 million bottles carrying the same description.

Reliance said some of its stock had been seized by state authorities, while e-commerce platforms had reportedly been asked to remove the products. According to the company, the developments caused substantial disruption to its business.

Other Beverage Companies Also Challenge FSSAI

Reliance is not the only beverage company contesting the regulator’s move. PepsiCo and Monster Beverage have also approached the courts over the FSSAI order.

Meanwhile, Red Bull has already secured court relief allowing it to continue using the “energy drink” description.

The Delhi High Court is also scheduled to hear similar petitions filed by PepsiCo and Monster Beverage.

For now, the interim order means Reliance can continue using the “energy drink” label on Campa products until the next hearing, while the broader dispute over FSSAI’s regulatory direction remains unresolved.
