Renting a home in India will undergo major changes in 2025, as the central government has officially notified the New Rent Rules 2025. The updated rules aim to make renting more transparent, safeguard tenant rights, reduce disputes, and streamline the process through full digital registration.
These changes particularly benefit working professionals, students, and families who relocate frequently, as security deposits are capped and the entire rent agreement process becomes simpler and more standardised.
One of the most significant reforms is the mandatory digital stamping and online registration of every rental agreement within 60 days of signing.
The government has also defined clear limits on security deposits, rules for rent hikes, guidelines for inspections, and a legal process for eviction. States have been instructed to upgrade their online systems to ensure seamless digital implementation.
Under the new rules, every rent agreement must be digitally stamped and registered online within a 60-day window. Earlier, many agreements were handwritten or signed on basic stamp paper without formal documentation, leaving room for disputes or illegal evictions.
Failure to register within the deadline will attract a minimum penalty of ₹5,000, with states allowed to fix higher penalties.
The aim is to build a fraud-free, traceable rental system with clear terms for both sides.
A major win for tenants is the new cap on security deposits:
Residential properties: Maximum two months’ rent
Commercial properties: Maximum six months’ rent
This dramatically reduces financial pressure, especially in metros like Bengaluru, Mumbai, and Pune, where deposits often reached ₹3–10 lakh for mid-range apartments.
Rent revisions will also follow a clear timeline:
Rent can be increased only after 12 months
A 90-day written notice is mandatory before any hike
This prevents sudden rent shocks and allows tenants time to adjust budgets or plan relocation.
Eviction rules are strictly regulated. Landlords must obtain an eviction order from the Rent Tribunal, and any forced eviction attempts — such as changing locks, cutting utilities, or intimidation — are punishable.
Tenants’ right to privacy has been formalised. Landlords must give 24-hour written notice before entering the property for inspection or repairs.
For essential repairs:
Tenants must inform landlords first
If the landlord fails to act within 30 days, tenants can get the repair done and deduct the cost from the rent, with proper bills
Police verification of tenants is now compulsory, improving security and creating an official record for both parties.
With fixed deposits, digital agreements, transparent rent revision norms, and clearly defined eviction and repair rules, renting a home from 2025 is set to become more predictable and organised — offering stability to millions of Indians who move for work and education.
