Trump Tightens H-1B Scrutiny for Employers Laying Off US Workers: Impact on Indians

US President Donald Trump has ordered federal agencies to apply greater scrutiny to H-1B visa applications from employers that have recently laid off, or plan to lay off, similarly situated American workers. The September 18 executive order directs the Departments of State, Labor and Homeland Security to consider such layoffs while reviewing labour applications, visa petitions and H-1B cases.

The administration says the move is intended to address what it describes as misuse of the H-1B programme, particularly by employers accused of replacing US workers with lower-paid foreign labour. The Labour Department has also been instructed to begin reviewing previously filed Labour Condition Applications within 30 days to determine whether further action is warranted.

For Indian professionals, the changes could have significant implications because Indian nationals make up a large share of H-1B beneficiaries. Employers that have recently carried out layoffs may become more cautious about sponsoring foreign workers for comparable positions, while applications could face additional scrutiny over wages, job duties and employment practices.

Separately, the administration has extended a $100,000 payment requirement for certain H-1B petitions involving workers outside the US. The restriction is being extended for another 12 months, until September 21, 2027, subject to specified exceptions.

The measures do not amount to a blanket ban on H-1B hiring. Their practical effect will depend on how US agencies implement the new review requirements and how employers respond to the additional costs and scrutiny.
