H-1B, H-4 Visas Prudentially Revoked in US Amid Interview Delays in India

Several H-1B and H-4 visa holders in the United States have reportedly received notices from US consulates stating that their visas have been “prudentially revoked,” amid widespread rescheduling and delays in H-1B visa interviews in India.

The development comes as the US government moves to tighten scrutiny of temporary work visa holders, including the expansion of social media screening for applicants and their dependents. Prudential revocation is a precautionary step and does not amount to a permanent visa cancellation or denial.

According to immigration experts, the number of prudential revocations has increased in recent weeks, particularly in cases where visa holders had previous interactions with law enforcement, even if those incidents did not result in convictions. In many instances, the issues had already been disclosed and cleared during earlier visa applications.

Immigration attorney Emily Neumann said that while a prudential revocation does not affect a person’s lawful status in the United States, it means the visa holder will face re-examination during their next visa interview. She noted that the affected individuals can legally remain in the US until their authorised stay expires but will be unable to re-enter the country using the revoked visa stamp.

Neumann questioned the efficiency of re-evaluating cases that had already undergone prior vetting, stating that visa screening has become an ongoing process rather than a one-time assessment.

The move follows a recent announcement by the US State Department that it would extend social media screening to H-1B applicants and family members on H-4 dependent visas. The practice was earlier introduced for international student visa applicants and is now being applied more broadly to temporary work visas.

A prudential visa revocation is defined as a temporary, precautionary cancellation issued when authorities believe further review of a visa holder’s eligibility is necessary. While individuals can continue to stay in the US legally, they cannot use the revoked visa to re-enter the country if they travel abroad until the issue is resolved at a subsequent visa appointment.
