Actor Vijay’s upcoming film Jana Nayagan has suffered a major legal setback after the Madras High Court temporarily stayed the issuance of its U/A certificate, sharply criticising the film’s producers for announcing a release date without securing mandatory certification.
During a hearing held on January 9, the High Court put a temporary halt on an earlier directive that had asked the Central Board of Film Certification (CBFC) to grant a U/A certificate to the film. The stay will remain in effect until the matter is heard in full, effectively blocking the film’s release in the immediate future.
The division bench, headed by Chief Justice Manindra Mohan Shrivastava along with Justice G Arul Murugan, observed that the CBFC should have been given adequate time to present its objections. The bench noted that procedural fairness was compromised and remarked that at least two to three days should have been provided to the certification body to respond.
Taking strong exception to the producers’ conduct, the court questioned how the makers could publicly announce a release date without having a certificate in hand. The bench remarked that fixing a release schedule prematurely amounted to creating artificial urgency and exerting pressure on both the censor board and the judicial system. The court clearly stated that such practices cannot be encouraged.
Representing the production house, KVN Productions, senior counsel argued that the objections stemmed from a complaint raised by a single CBFC member, despite the film having been screened before the certification panel. It was further submitted that the film had been scheduled for release on January 9, aligning with the Pongal festival window.
However, the court rejected the urgency argument and reiterated that the producers should have waited for formal certification before locking in a release date. The bench observed that by announcing the release in advance, the makers attempted to corner the system into fast-tracking approvals.
The court also raised questions over the CBFC’s decision to file an appeal at short notice, asking what compelled such haste. With the case now posted for further hearing on January 21, it has become clear that Jana Nayagan will miss the lucrative Pongal release period, a significant blow for the makers.
Earlier in the day, another bench of the High Court had also made sharp observations, terming the developments a “dangerous trend” and criticising last-minute interventions in the certification process. The court noted that the complaint against the film appeared to be an afterthought, adding to the complexity of the case.
Jana Nayagan is directed by H Vinoth and stars Vijay alongside Mamitha Baiju and Pooja Hegde. The film had generated significant anticipation, but the legal developments have now cast uncertainty over its release timeline.
The High Court’s observations are being seen as a strong message to filmmakers, reinforcing that regulatory procedures cannot be bypassed or rushed through by commercial pressures.
