The Women Reservation Act 2023 has officially been brought into force following a late-night notification by the Union Law Ministry, even as Parliament continues to debate amendments related to its implementation.
The development has drawn attention due to its timing, as the law was operationalised while discussions were still ongoing in both Houses regarding its future rollout.
The Act provides for a 33 per cent reservation for women in the Lok Sabha and state legislative assemblies. With the notification now in effect, the law has formally become operational.
However, officials clarified that despite being in force, the provisions of the Act cannot be implemented immediately in the current House.
According to officials, the actual implementation of women’s reservation will depend on the completion of the delimitation exercise, which involves redrawing constituency boundaries based on updated population data.
This means that while the law is active, its benefits are expected to be realised only after the next delimitation process, which is currently projected for future electoral cycles.
The decision to notify the Act during an ongoing parliamentary debate has raised questions among political observers.
Officials cited “technicalities” as the reason behind the timing but did not provide detailed explanations. The move has added another layer of complexity to the already intense political discussions surrounding the bill.
Meanwhile, Parliament is actively debating amendments related to the Women’s Reservation framework, including its linkage with delimitation and future implementation timelines.
The discussions reflect broader political differences over how and when the reservation should be enforced.
