O.P. Rawat Explains ECI Decision-Making Amid West Bengal Voter List Debate

Former Chief Election Commissioner O.P. Rawat has spoken about decision-making within the Election Commission of India amid ongoing scrutiny over the poll panel and the Special Intensive Revision of electoral rolls in West Bengal.

Rawat said decisions in the three-member Election Commission are taken either unanimously or through a majority view when differences arise. The Representation of the People Act, 1951 also provides that where members differ, the majority opinion prevails.

Discussing the West Bengal voter-list revision, Rawat raised concerns about the consequences of errors in the electoral process. Recent Election Commission data submitted to the Supreme Court showed that around 93 per cent of cases decided by appellate tribunals resulted in voters being restored to the electoral rolls. At the same time, more than 37 lakh appeals related to the revision remained pending as of September 2026.

Rawat also said that determining whether individuals are illegal immigrants falls under the jurisdiction of the Ministry of Home Affairs rather than the Election Commission. He expressed concern over scrutiny of the poll body's credibility and called for the Chief Election Commissioner and other commissioners to address concerns collectively and transparently.

The comments come as the Election Commission faces continuing questions over the West Bengal SIR process, including the handling of deleted voter names and the large number of pending appeals before tribunals.
